Under the Ordinance, a specimen shall be treated as part of the “personal or household effects” of a person if the specimen is:
- personally owned or possessed for non-commercial purposes only; and
- worn or carried by the person, included in his personal baggage or forms part of a household move when the specimen is being imported, exported or re-exported.
Exemption from licensing requirement is provided for personal or household effects if they meet certain criteria.
Import, Export or Re-export of Personal or Household Effects
The import, export or re-export of personal or household effects, which were legally acquired, are exempt from licensing requirements, except:
- giant panda and rhino
- live animals
The exemption also applies to certain specimens which were acquired by a person outside his usual place of residence.
Possession of Personal or Household Effects
Exemption is provided for possession of personal or household effects, except giant panda and rhino. In addition, live animals or plants kept for personal use must also be legally acquired.
Tourist Souvenir Items
Tourist souvenir items which were acquired outside the person's usual place of residence are provided with similar exemption from licensing requirements as that of “personal or household effects”, if the items are legally acquired personal or household effects, and are:
- Appendix III species (other than live animals)
- certain dead specimens or their parts or derivatives of Appendix II species (subject to Notification from CITES Secretariat or quantity limits
Import, export or re-export of souvenir items not meeting the above criteria and entitled to the exemption must fulfill the licensing requirements.
